Federal regulation of water quality was first established under the Federal Water Pollution Control Act of 1948. This Act was later amended in 1972 and became commonly known as the Clean Water Act (CWA). Section 404 of the Clean Water Act established regulatory requirements regarding impacts to wetlands and other waters of the United States (WOTUS).
Canvas Biologists are trained to identify and delineate wetlands in the field and can help you navigate the permit application process. Canvas can determine the potential impacts of your proposed project, assist you with minimizing impacts, and act as your representative agent for interactions with the USACE. Impacts to wetlands and other WOTUS are required to be minimized, and depending on the proposed project, a regional general permit (RGP), nationwide general permit (NWP), or individual permit (IP) may be required. The United States Army Corps of Engineers (USACE) may require a pre-construction notification (PCN) or a permit application depending on the permit and impacts.
Canvas Biologists are trained to effectively delineate and identify wetlands. Wetland determinations help identify the extent of impacts to wetlands and other waters of the United States. The impact extent and type of activity will determine what permits are required, if any. Wetland delineations are also a critical part of establishing wetland mitigation banks.
Canvas can develop customized wetland prediction models to guide you with planning of rights-of-way, well sites, access roads, and other construction projects using geographic information system (GIS). Our models use the best available data in your area of interest to best identify the most likely and least likely wetland locations. Wetland prediction models are intended to aid initial planning, they are not intended to replace field investigation.
When wetland impacts are unavoidable, the USACE may require on-site mitigation or compensatory mitigation for temporary and permanent impacts to wetlands or other waters of the United States. Canvas Biologists can create and implement mitigation plans on your behalf.
On-site mitigation typically requires monitoring for several years to ensure the site has been effectively mitigated. We provide monitoring and annual reports to the USACE according to your mitigation plan to maintain permit compliance.
